It is with heavy hearts that we acknowledge the passing of our colleague and dear friend Mitchell S. Brachman.
For the past eighteen years, Mitch has been a valuable, dedicated, and irreplaceable KGSW member and impactful advocate for homeowners associations, directors, and community managers. Among his many professional achievements, he was the prevailing attorney of record in the published appellate decision, Carolyn v. Orange Park Community Association (2009) 177 Cal. App. 4th 1090, holding that a homeowners association’s recreational trail system is not transformed into a public accommodation subject to the Americans with Disabilities Act or California Fair Housing Laws simply by members of the public using the trials.
Over the past 35 years, KGSW has never had anyone who was more beloved and respected than Mitch. He demonstrated extraordinary tenacity in service of his clients and acted as a mentor and role model to the firm’s younger attorneys. In the last few years, he did so with incredible grace and bravery despite his own health issues. He will be sorely missed!
Whether obtaining a favorable resolution of complex litigation matters or providing general counsel to homeowners associations or corporations, Mitchell Brachman has achieved significant results and has developed successful relationships with a diverse client base.
HOMEOWNERS ASSOCIATIONS
Mr. Brachman is highly regarded for his expertise in counseling common interest developments as their general counsel in both litigation and corporate matters. As General Counsel, Mr. Brachman advises on all HOA issues, including the interpretation of Association CC&Rs and Bylaws, lender and contractor disputes, disability rights disputes, employment matters, insurance coverage and fiduciary obligations of directors and officers.
Mr. Brachman has also been lead counsel in the representing homeowners associations in disputes regarding defective construction. He also has extensive experience in defending claims asserting the application of the Americans with Disabilities Act to homeowners associations.

Mr. Brachman has extensive trial experience in the representation of executives in a wide array of employment matters, including charges of fraud, misappropriation, wrongful termination and breach of contract.
ENTERTAINMENT/INTELLECTUAL PROPERTY
Mr. Brachman practice encompasses a wide range of both litigation and transactional matters including counseling and negotiating contracts and other financial agreements involving film and television, transactions.
REAL PROPERTY
Mr. Brachman practice involves representation of title companies in defective title litigation and significant experience in the evaluation of mortgage fraud. Mr. Brachman also has significant expertise in the defense of mortgage broker errors and omissions claims.
